ACCEPTABLE USE POLICY

SYSTEM AND NETWORK ABUSE

Violations of system or network security are prohibited and may result in criminal and/or civil liability. Examples of system or network security violations include, without limitation, the following:

You may not use Intrascape's services or equipment to create or send Internet viruses, worms or Trojan horses, or for pinging, flooding or mail bombing, or engaging in denial of service attacks. It is also prohibited for any customer to engage in any other activity that is intended to disrupt or interfere with, or that results in the disruption of or interference with, the ability of others to effectively use Intrascape's services and equipment (or any connected or unconnected network, system, service or equipment) or conduct their business over the Internet.

ADULT CONTENT AND OBSCENE SPEECH AND OR MATERIALS

Content hosted on Intrascape servers may not be of an adult nature, obscene, offensive, or pornographic. Intrascape will deny use of any or all of it's services (including, but not limited to, sub-domains hosting on portland.co.uk, port5.com, 8bit.co.uk) where content is found to be obscene, offensive, or pornographic. Determining these criteria is within Intrascape's sole discretion.

The use of Intrascape's services to advertise, transmit, store, post, display, or otherwise make available child pornography or obscene speech and or material is prohibited. Intrascape is required by, and will notify, law enforcement agencies when it becomes aware of the presence of child pornography on, or being transmitted through, its services. The use of Intrascape's services as a means to transmit or post defamatory, harassing, abusive, racist, or threatening language is prohibited.

SERVER AND SYSTEM RESOURSES

If you initiate, promulgate, or otherwise participate in the overuse or abuse of system resources, your account may be suspended or terminated without notice. Intrascape may, at its discretion, give you the option to pay additional fees (which will depend on the resources required), reduce the resources used to an acceptable level, or upgrade your service to a more appropriate plan. Intrascape will be the sole arbiter of what is considered to be a high server usage level. Any account deemed to be adversely affecting server performance or network integrity will be shut down without prior notice.
If you exceed the prescribed usage limits for data transferred per month, we reserve the right to charge you the overage charges that are applicable for the excess usage during that month. For shared hosting services, we also reserve the right to suspend the connection until the beginning of the next month. Certain services have fixed storage limits, and you shall not be able to exceed such limits.

We may also email you, at the end of the month, and give you the option of upgrading to a service that is appropriate for your usage levels. If you notify us that you wish to upgrade, you will pay the fees for the upgraded service from the day on which we upgrade your service. Any service upgrade does not constitute a variation of our agreement with you.

ZERO TOLERANCE EMAIL POLICY
If you send unsolicited bulk and/or commercial messages over the Internet (known as "spamming") regardless of whether or not it overloads a server or disrupts service to Intrascape's customers, you may be subject to immediate cancellation and/or fines. The term "spamming" also includes, but is not limited to, maintaining an open SMTP policy, engaging in spamming using the service of another ISP or IPP and referencing in the spam a Web site hosted on an Intrascape server, and selling or distributing software (on a Web site residing on an Intrascape server) that facilitates spamming. Violators will be assessed a minimum fine of £200 and will face immediate suspension. Intrascape may cancel your account and terminate your services immediately, with no prior notice and no refund of unused service fees. Intrascape reserves the right to determine, in its sole and absolute discretion, what constitutes a violation of this provision.

DOMAIN NAMES
Customers who buy domain name services from us acknowledge and agree that once the customer has paid for the domain name we will register that domain name and you will be marked as the registrant. We cannot amend any domain name following purchase/ registration. It is therefore your responsibility to ensure that you enter the domain name correctly when you apply for it. You agree that you accept and shall comply with the terms of the domain name registrar applicable for the purchased domain name. Customers acknowledge that unless otherwise indicated, domain registration and payment for that service, is separate from other services offered by Intrascape Communications.

Intrascape will not refund any payment to a customer in the event that any breach of any term of this policy by a customer results in the suspension, cessation or other interruption of the account. In all cases Intrascape will decide the penalty for any policy violation and such decisions will be final.
